Your numbers

The employer pays the notice instead. It counts as time worked for the 13th salary and vacation.

Overtime, commissions and other regular extras, averaged over the last 12 months. They count towards the result.

Periods of 12 months already earned and not enjoyed. Leave 0 if you are up to date.

Each dependent lowers the income tax base by R$189.59.

Look it up in the FGTS app. Left empty, it is estimated from your salary and time of service.

The first installment, if it was paid, is taken off what is owed.

How to calculate termination pay

  1. Step 01

Choose the reason and the notice

Dismissal without cause, resignation, mutual agreement, dismissal with cause or end of a contract. Then say whether the notice is worked or indemnified.

  2. Step 02

Enter the dates and the salary

Use the admission date and the last day of work, or the date of dismissal when the notice is indemnified. Add the average of overtime and commissions, if any.

  3. Step 03

    Add what you know

Overdue vacation, the FGTS balance and the first installment of the 13th salary already received bring the result closer to the real one. An empty FGTS balance is estimated.

  4. Step 04

    Read earnings, deductions and FGTS

The result separates what the employer pays, what is deducted and what you can withdraw from the FGTS, with the fine.

What you get

  • One rule per reason

Dismissal with cause loses the 13th salary and proportional vacation, resignation has no fine or withdrawal, a mutual agreement pays half of the notice and of the fine. Each case is calculated its own way.

  • Proportional notice, automatic

It is 30 days plus 3 for each full year of service, up to 90, and an indemnified notice counts as time worked for the 13th salary and vacation.

  • Taxes only where they apply

INSS and income tax are charged on the salary balance and the 13th salary. Indemnified notice and vacation paid at termination are indemnities, without those deductions.

  • FGTS and fine apart

It shows the deposit on the amounts, the balance, the fine of 40% or 20% and how much you can withdraw.

How termination of a labor contract works

The salary balance pays the days worked in the last month. The notice is 30 days plus 3 days for each full year of service, at most 90. If the employer dispenses the work, the notice is indemnified and that period counts as service time, which adds twelfths to the 13th salary and vacation. In a mutual agreement under article 484-A of the CLT, an indemnified notice is paid at half.

The proportional 13th salary counts a twelfth for each month worked in the year, from 15 days in the month. Proportional vacation counts the months since the last anniversary of the admission and adds the constitutional third. Overdue vacation, when there is any, is paid in full with the third. The STJ treats vacation paid at termination as an indemnity, free of income tax, and an indemnified notice does not pay INSS.

The FGTS has its own side: the employer deposits 8% on the termination amounts and pays the fine over the balance, 40% on a dismissal without cause and 20% on a mutual agreement, where only 80% of the balance can be withdrawn. On a resignation or a dismissal with cause the balance stays locked. Someone in the anniversary withdrawal (saque aniversário) can only withdraw the fine on a dismissal: the balance stays in the account and is released in the birthday month.

Proportional notice period by years of service

The notice period is 30 days, plus 3 days for every completed year of service at the company, up to a limit of 90 days (Lei 12.506/2011).

Frequently asked questions

What is included in a dismissal without cause?

Salary balance, notice (worked or indemnified), proportional 13th salary, overdue and proportional vacation with a third, the FGTS withdrawal and the 40% fine. Unemployment insurance is paid separately by the government, if you qualify.

Does an indemnified notice pay INSS and income tax?

No. An indemnified notice is an indemnity. The calculator also adds it to the service time for the proportional 13th salary and vacation.

What is the difference between resigning and a mutual agreement?

On a resignation you receive the salary balance, 13th salary and vacation, but no FGTS withdrawal or fine. On a mutual agreement the employer pays half of an indemnified notice and a 20% fine, and you withdraw 80% of the balance, without unemployment insurance.

What if I am dismissed with cause?

You only receive the salary balance and overdue vacation with a third. You lose the 13th salary and proportional vacation, the notice, the FGTS withdrawal and the fine.

I chose the anniversary withdrawal (saque aniversário). What changes?

On a dismissal without cause you can only withdraw the 40% fine, charged on all the deposits of the contract, even the ones you already withdrew. The balance stays in the account and is released little by little in your birthday month, by a percentage of the balance plus a fixed amount. A contract that simply ends, such as a trial period, releases nothing. Tick the option in the calculator to see the numbers.

Was there a special release of the balance for people dismissed recently?

Yes, the MP 1.331/2025 released the balance of people in the anniversary withdrawal who left a job from 2020 up to 23 December 2025, in payments that ended on 1 June 2026. Whoever is dismissed after that date follows the general rule, with only the fine released.

Can I go back to the severance withdrawal?

You can ask for the change in the FGTS app, but there is a waiting period before it counts for a dismissal. If a dismissal is close, the change will not help in time. Check the current term in the app.

How do I find my FGTS balance?

In the FGTS app or the Caixa statement. If you leave the field empty, the calculator estimates 8% of today's salary per month of service, without correction, which is only a reference.

Does the calculator consider collective agreements?

No. It uses the general CLT rules. Collective agreements, job stability, time banks and other situations can change the amounts, so confirm with the payroll department or an accountant.

How many days of notice do I get after 5 years at a company?

45 days: 30 days plus 3 for every completed year of service, up to a maximum of 90.

How do I calculate the 40% FGTS fine?

It is 40% of everything the company deposited in your FGTS during the contract, not only the current balance if you have made withdrawals. The company pays it on dismissal without cause and it does not come out of your balance. For R$20,000.00 deposited, the fine is R$8,000.00.
